1. Acceptance of terms
By downloading, installing, or using the FamSplit mobile application ("App"), you ("User", "you") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you do not agree to these Terms, do not use the App.
These Terms form a legally binding agreement between you and FamSplit. If you are using FamSplit on behalf of a family group or organisation, you represent that you have authority to bind all members to these Terms.
You must be at least 13 years old to use FamSplit. By using the App, you confirm you meet this age requirement.
2. What FamSplit provides
FamSplit is a personal finance and family expense-splitting application that:
- Tracks personal income and expenses across categories.
- Calculates proportional (pro-rata) expense splits based on members' declared salaries.
- Generates monthly settlement summaries showing what each family member owes or is owed.
- Provides AI-powered spending insights and financial question answering (Premium feature).
- Allows multiple family or household groups with distinct members and expenses.
FamSplit is a tracking and calculation tool only. It does not hold money, process payments, operate as a bank, or provide regulated financial advice. Actual money transfers between family members are handled independently by the users.
3. Accounts and registration
Creating an account
- You register with a mobile phone number and create a password.
- You must provide accurate, current, and complete information at registration.
- You are responsible for maintaining the confidentiality of your password.
- You are responsible for all activity that occurs under your account.
Account security
- Do not share your password or authentication tokens with anyone outside your family group.
- Notify us immediately at abrar.md27@gmail.com if you suspect unauthorised access to your account.
- We are not liable for losses caused by unauthorised access resulting from your failure to keep credentials secure.
One account per person
Each phone number may be associated with only one FamSplit account. Creating multiple accounts to circumvent restrictions is prohibited.
Account deletion
You may delete your account at any time from Profile → Delete Account in the App. Deletion permanently removes all your data from our systems within 30 days. This action cannot be undone.
4. Acceptable use
You agree to use FamSplit only for its intended purpose: tracking personal and shared expenses, calculating fair splits, and managing family group finances.
When adding expenses or income figures, you agree to:
- Enter accurate financial information to the best of your knowledge.
- Not manipulate salary figures to artificially inflate or deflate your pro-rata share.
- Obtain consent from family members before adding them to a group.
- Resolve disputes about shared expenses directly with family members — FamSplit is a calculation tool, not an arbitration service.
5. Prohibited uses
- Attempting to reverse-engineer, decompile, or disassemble the App or its backend services.
- Using the App to commit fraud, money laundering, or any financial crime.
- Uploading or transmitting malware, viruses, or any malicious code.
- Attempting unauthorised access to other users' accounts, data, or the backend infrastructure.
- Scraping, crawling, or bulk-extracting data from the service.
- Using the API or backend directly in ways not supported by the official App.
- Creating or distributing automated bots that interact with the App.
- Using FamSplit to harass, threaten, or harm other users.
- Impersonating another person or providing false identity information.
- Violating any applicable law or regulation.
7. Financial information disclaimer
The pro-rata calculations, AI spending insights, and financial suggestions provided by FamSplit are:
- Based solely on the data you enter into the App.
- Intended for informational and personal budgeting purposes only.
- Not a substitute for advice from a qualified financial advisor, chartered accountant, or other professional.
FamSplit does not guarantee the accuracy, completeness, or suitability of any calculation, insight, or AI-generated suggestion for your specific financial situation. You use all financial information from the App at your own risk.
FamSplit does not hold, transfer, or control any funds. Settlement amounts shown in the App are calculations; actual payment is entirely between you and your family members.
8. Intellectual property
The FamSplit App, including its design, code, brand, trademarks, and content, is owned by FamSplit and protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not:
- Copy, modify, distribute, or create derivative works from the App.
- Use FamSplit's brand name, logo, or trademarks without written permission.
- Sub-license or resell access to the App or its features.
9. User-generated content
You retain ownership of all financial data, notes, and information you enter into FamSplit.
By using FamSplit, you grant us a limited licence to store, process, and transmit your data solely to provide the Service described in these Terms. We do not use your data for any other purpose.
You are responsible for the accuracy of the data you enter. FamSplit is not liable for financial decisions made based on inaccurate data you have provided.
10. Termination
Your right to terminate
You may stop using FamSplit and delete your account at any time through the App's Profile settings. There are no penalties for leaving.
Our right to terminate
We may suspend or terminate your account, with or without notice, if:
- You violate these Terms or our Prohibited Uses policy.
- Your account is used for fraudulent, illegal, or abusive activity.
- We are required to do so by applicable law.
- We discontinue the Service (with reasonable advance notice).
On termination, your right to use the App ceases immediately. We will delete your account data per our Privacy Policy retention schedule.
11. Disclaimer of warranties
FamSplit is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose.
- Uninterrupted or error-free operation.
- Accuracy of calculations or AI-generated insights.
- Compatibility with all devices or operating systems.
- Security or freedom from malware (though we take all reasonable precautions).
We do not warrant that the App will be available at all times. We may perform maintenance, apply updates, or experience outages that temporarily restrict access.
12. Limitation of liability
To the fullest extent permitted by applicable law, FamSplit and its developers shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of data, profits, goodwill, or other intangible losses.
- Financial losses arising from reliance on calculations, settlements, or AI advice from the App.
- Disputes between family members arising from expense splits or settlements calculated by the App.
- Unauthorised access to your account caused by your failure to maintain credential security.
- Interruptions or failures of the Service caused by third-party infrastructure (Railway, OpenAI, etc.).
In any event, our total liability to you for all claims arising from your use of FamSplit shall not exceed the amount you paid to FamSplit in the 12 months preceding the claim, or ₹500 (whichever is greater).
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by applicable law.
13. Indemnification
You agree to indemnify and hold harmless FamSplit and its developers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the App in violation of these Terms.
- Your violation of any applicable law or third-party rights.
- Any content or data you submit to the App that causes harm to others.
- Disputes between you and other family group members.
14. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Informal resolution
Before filing a formal complaint, please contact us at abrar.md27@gmail.com to resolve the issue informally. We will make a genuine effort to resolve disputes within 30 days.
Formal disputes
If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
Consumer rights
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Protection Act 2019 (India) or other applicable consumer protection legislation.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Notify you via push notification or in-app message before the changes take effect.
- For significant changes that affect your rights, we will request explicit re-acceptance.
Continued use of FamSplit after updated Terms are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.
